TERMS OF SERVICE
THESE TERMS OF SERVICE ARE IN EFFECT AS OF FEBRUARY 10, 2021
_{By ordering a commission from me, Sweird ("I, the Artist"), you ("the Client", "you, (s)he/ they") affirm to have read and agree to be legally bound by the following Terms of Service listed below. Failure to abide by the Terms of Service may result in a rejected/ cancelled commission with or without a refund, and/ or a blacklist/ public service announcement. Please note that these Terms of Service may be subject to change without prior notice.}COMMISSION T.O.S
GENERAL
_{You cannot trace or copy any of my artwork.}_{You agree that my artwork and designs are NEVER to be used for NFTs. Do not use my work to promote and/or earn crypto currency.}_{All commissions are personal, non-commercial/non-profit use only. Do not resell or use my art as merchandise unless stated otherwise.}_{No refunds after the commission is finished.}ARTIST
_{I have the rights to all copyrights of my artworks. I can advertise and display any artwork of mine unless commissioner requested privacy.}_{I have the right to decline any commission request.}COMMISSIONER
_{Commissioner has the right to re-upload their commission wherever as long as they credit me.}_{Commissioner cannot claim their commissioned artwork as their own.}_{Commissioner cannot edit their commissioned artwork unless permission was given.}_{Commissioner cannot use their commissioned artwork for commercial purposes unless we discussed otherwise.}_{YouTube/Twitch and Merchandise: A contract with be drafted depending on the circumstances we discussed.}_{NFTs: Do not use my work to promote and/or earn crypto currency.}_{Personal Accessories: It is permitted as long as the items are not used to sell commercially.}PAYMENT
_{I only accept USD via PayPal as payment.}_{The first half of the payment must be paid through an invoice in order for me to start the commission.}_{Once I received the first half, the sketch of the commission will be sent over for edits and approval.}_{If the sketch is approved, the second payment must be paid through the same invoice in order for me to finish the commission.}_{Request for refund is available during the sketch stage of the commission, after it is approved the option is off the table.}PROCESS
_{Payments must be made in FULL before I start the commission. Please be sure to have all required funds for your commission or the commission will be declined.}_{You understand all commissions that will be be done digitally will have no hard copies. The Client is paying for a service/digital good and will not require any shipping of any kind.}_{I will send sketches of said commission via specific social media messaging method. Large edits are allowed during this stage.}_{After the sketch has been confirmed for finalizing, only small edits can be made during this stage.}_{Commission takes at most 1 month to complete, I will notify you of any delay.}_{Once the commission is done, full resolution PNG files will be sent.}_{In regards to traditional paintings the price of the art does not include any shipping or handling fees and the artwork will not be physically mailed to you unless shipping and handling is paid for and arranged.}

_{I have the right to all copyrights of my designs' artwork. I can advertise and display any artwork of mine unless the adopter requested privacy.}_{I have the right to decline trading or selling designs to any users.}DESIGN OWNER
_{Owner has the right to re-upload their design wherever as long as they credit me.}_{Owner can draw or order commissions of the design.}_{Owner can use the design on closed species or create different versions of it as long as they will all be traded or sold together.}_{Owner can make whatever edits on the design.}_{Owner cannot claim their design as their own.}_{Owner cannot use the design for commercial purposes unless we discussed otherwise.}_{YouTube/Twitch and Merchandise: A contract with be drafted depending on the circumstances we discussed.}_{NFTs: Do not use my work to promote and/or earn crypto currency.}_{Personal Accessories: It is permitted as long as the items are not used to sell commercially. The items must be traded/gifted/resold to the new owner when transferring the design's ownership.}PAYMENT
_{I only accept USD via PayPal as payment.}_{Full payment must be paid through an invoice in order for me to give you the files.}_{A payment plan may be available under certain conditions and it must be previously discussed with me before buying.}_{Request for refund is not available after I sent the files over.}_{I will only accept a payment plan if the design is over $150.}_{The maximum time for a payment plan is 2 months.}_{The payment plan will include a 50% down payment, and the rest can be paid periodically depending on the discussed agreement.}_{You will receive two notices/reminders, one per 3 days, when the payment plan is past due.}_{Once you've passed those two notices, the payment plan will no longer be valid and I will refund the payment back.}TRADING/SELLING
_{The design can be gifted.}_{The design can be traded for other design/s, physical items, art services, etc.}_{The design can be sold or vouch at a higher value if commissioned art is attached.}COPYRIGHT + USAGE POLICY
_{I, The Artist, hold every right to the produced drawing, not The Client. Therefore, I’m allowed to use the copyrighted artwork to: Promote myself within any place or website, To display or post it where I like.}_{WITHOUT commercial purchase, the CLIENT is allowed to: Use the copyrighted artwork for personal use, Print the art for themself (and claim the right of their character(s) but not the drawing itself).}_{Commissions are for personal use only unless otherwise stated. You cannot use my commissions for merchandise or resale. You may pay to have rights of the design for commercial use and resale. Credit is still required for usage of the artwork}_{If you wish to purchase a design/artwork commercially contract with be drafted depending on the circumstances we discussed.}_{Do not redistribute my work on any site without crediting me.}_{If you redistribute the commissioned works without paying the release fees/royalty agreement, I reserve the right to decline future commissions.}
